Terms and Conditions
Unlio is operated by 01HIO AG, Reichenburg, Canton Schwyz, Switzerland (“01HIO”, “we”, “us”).
These Terms and Conditions (“Terms”) govern access to and use of the Unlio platform and related services (the “Platform”).
By creating an account or using the Platform, you agree to these Terms.
1. Scope and Purpose
1.1 Purpose of the Platform
The Platform enables users to create, publish, discuss, and participate in initiatives and related activities.
1.2 Swiss Operation
The Platform is operated from Switzerland and is primarily intended for users in Switzerland. Access from other jurisdictions is not actively targeted.
1.3 Applicability
These Terms apply to all users of the Platform.
2. Eligibility and Accounts
2.1 Minimum Age
You must be at least 16 years old to create an account and use the Platform.
2.2 Individual Accounts
Accounts are personal and must be created by a natural person.
Each person may maintain only one account.
You are responsible for maintaining the confidentiality of your login credentials.
2.3 Organisational Profiles
Accounts always represent individuals.
The Platform may allow users to create and manage organisational profiles. Organisational profiles are managed by individual account holders who declare that they are authorised to represent the organisation.
01HIO may request verification of such authorisation.
2.4 Accuracy of Information
You must provide accurate information when required for specific features (e.g., public profile activation, identity verification, participation requirements).
01HIO may request identity verification where reasonably necessary for security, compliance, fraud prevention, or initiative integrity.
3. Account Deletion, Retention, and Content Redaction
3.1 User-Initiated Deletion
Users may request deletion of their account.
Deletion occurs in two stages:
- The account is first deactivated for a limited period to allow reactivation.
- After completion of the deletion workflow, personal account data is deleted or anonymised in accordance with the Privacy Policy, unless retention is required for legal obligations, objectively necessary security measures, or the establishment, exercise, or defence of legal claims.
3.2 Effect on Published Content
Deletion of an account:
- Removes personal account data and public profile linkage.
- Removes public attribution of previously published content.
- Does not automatically remove published content from initiatives.
Public contributions may remain accessible in anonymised form to preserve the integrity, continuity, and transparency of initiative records.
For the purposes of these Terms, anonymisation means processing information so that identification of a user is no longer possible by means reasonably likely to be used by the Platform or third parties.
3.3 Embedded Personal Data and Illegal Content
Requests concerning personal data contained within published content are assessed separately from account deletion.
If a published contribution contains personal data (about you or third parties) that should not be publicly available, or if content is alleged to be unlawful, you may submit a request through the reporting mechanism described in Section 7.
01HIO may remove, restrict, redact, or otherwise limit content where required by applicable law or where it violates these Terms or the Community Guidelines.
3.4 Inactive Accounts
01HIO may deactivate and delete accounts that remain inactive for an extended period, following prior notice to the registered email address.
The same deletion and anonymisation principles apply.
4. Identity and Participation Model
4.1 Public Profiles
Users may activate a public profile using their real name.
Public profile information and publicly visible contributions may be accessible to other users and to non-registered visitors and may be indexed by search engines, depending on Platform configuration.
4.2 Initiative Participation Identifiers
Participation within an initiative may be represented using an initiative-specific participant identifier.
Unless a user explicitly links participation to their public profile, their identity is not publicly displayed within that initiative.
Participant identifiers are designed to limit public attribution but do not constitute a guarantee of anonymity.
4.3 Voluntary and Sensitive Information
Certain profile fields, including demographic information, are voluntary and processed only in accordance with the Privacy Policy.
Particularly sensitive personal data is processed only on the basis of explicit consent and may be withdrawn at any time.
Withdrawal of consent does not prevent continued use of the Platform but may limit access to specific features.
4.4 Internal Access
01HIO and authorised moderators or administrators may access account-linked information solely for security, moderation, enforcement of these Terms, and compliance with applicable law.
Access is restricted to authorised persons and subject to internal access controls and confidentiality obligations.
Information may be disclosed to authorities where required by applicable law or valid legal process.
5. User Content and Licence
5.1 Responsibility for Content
Users are solely responsible for content they publish on the Platform.
Content must comply with applicable law, these Terms, and the Community Guidelines.
Acceptance of the Community Guidelines may be required before participating in initiatives.
5.2 Licence to 01HIO
Users retain ownership of their content.
By publishing content on the Platform, you grant 01HIO a non-exclusive, worldwide, royalty-free licence, including the right to authorise technical service providers acting on its behalf, to host, store, reproduce, display, distribute, technically process, format, archive, and back up your content solely for the purpose of operating, maintaining, securing, improving, and making the Platform available, and preserving initiative records.
This licence continues for as long as the content remains available on the Platform and, where necessary, for legal compliance, dispute resolution, enforcement of these Terms, and preservation of initiative records in anonymised form.
01HIO may use anonymised and aggregated information derived from user content and platform activity for analytical, statistical, reporting, and commercial purposes, provided that such information:
- Does not identify individual users,
- Does not enable re-identification,
- Does not reproduce identifiable contributions.
Nothing in this section transfers ownership of user content to 01HIO or grants 01HIO the right to commercially exploit identifiable contributions outside the Platform.
5.3 No Obligation to Provide Editing Features
01HIO is not obligated to provide functionality allowing users to edit or delete individual items of published content.
Nothing in this section limits mandatory statutory rights, including rights to rectification or erasure where applicable.
6. Prohibited Conduct
Users must not:
- Violate applicable law
- Infringe third-party rights
- Publish unlawful, defamatory, or misleading content
- Harass, intimidate, or threaten others
- Attempt to gain unauthorised access to systems
- Use the Platform to facilitate unlawful conduct
The Community Guidelines form part of these Terms.
7. Moderation, Notice-and-Action, and Appeals
7.1 No General Monitoring
01HIO does not generally monitor all user content.
7.2 Delegated Moderation
Initiative owners and designated moderators may be granted moderation capabilities within the scope of their initiatives.
Such powers are delegated by 01HIO and must be exercised in accordance with these Terms and the Community Guidelines.
01HIO retains ultimate authority over moderation decisions.
7.3 Reporting Content
Users or third parties may report content believed to violate these Terms or applicable law.
Reports are reviewed within a reasonable period, taking into account complexity and potential risk.
7.4 Enforcement Actions
01HIO may:
- Remove content
- Restrict visibility
- Suspend participation
- Suspend or terminate accounts
Decisions are made in good faith based on information reasonably available at the time.
Where practicable, affected users will be informed and may request review.
7.5 Appeals
Users may request review of moderation decisions through the designated contact channel.
Appeals are reviewed without undue delay.
8. Offline Activities
Initiatives may involve offline events organised by users.
Organisers and participants are solely responsible for planning, safety, and legal compliance.
01HIO is not an organiser or contracting party to offline arrangements.
9. Paid Features
The Platform may introduce paid features or subscription models.
Paid services may be subject to additional service-specific terms.
Nothing in these Terms limits mandatory consumer protection or data protection rights under applicable law.
10. Availability and Changes to the Service
The Platform is provided on an “as available” basis.
01HIO does not guarantee uninterrupted or error-free availability.
01HIO may modify, suspend, or discontinue features at any time.
For paid services, material discontinuation will, where reasonably possible, be preceded by notice and, where feasible, an opportunity to access or export relevant data.
11. Force Majeure
01HIO is not liable for failure or delay caused by events beyond its reasonable control, including infrastructure failures, widespread cyber incidents, governmental actions, or network disruptions.
This does not exclude liability for unlawful intent or gross negligence.
12. Indemnification
To the extent permitted by law, users agree to indemnify and hold 01HIO harmless from third-party claims directly and predominantly caused by:
- Content they publish
- Violation of these Terms
- Unlawful conduct
This does not apply to claims resulting from 01HIO’s unlawful intent or gross negligence.
13. Limitation of Liability
Nothing in these Terms excludes or limits liability where prohibited by law.
To the extent permitted by Swiss law:
- 01HIO is not liable for indirect damages.
- Liability for ordinary negligence is limited to foreseeable and typical damages.
- For paid services, total liability is limited to fees paid in the twelve months preceding the event giving rise to the claim.
01HIO remains fully liable for unlawful intent or gross negligence.
14. Data Protection
01HIO acts as the controller for personal data processed in connection with operation of the Platform.
Personal data is processed in accordance with the Privacy Policy.
Nothing in these Terms limits mandatory statutory data protection rights.
15. No Partnership or Agency
Nothing in these Terms creates a partnership, agency, joint venture, employment, or fiduciary relationship.
16. Interpretation
These Terms are interpreted in accordance with their plain meaning and applicable law. Headings are for convenience only.
17. Modification of Terms
01HIO may update these Terms.
If a change materially affects users’ rights or obligations, reasonable notice will be provided.
Continued use of the Platform after the effective date constitutes acceptance.
If you do not agree, you may stop using the Platform and request account deletion.
18. Severability
If any provision is invalid or unenforceable, the remaining provisions remain valid to the fullest extent permitted by law.
19. Governing Law and Jurisdiction
These Terms are governed by Swiss law.
The courts at the registered seat of 01HIO AG in Switzerland have jurisdiction, unless mandatory consumer protection rules require otherwise.
